The assertions were made by Justice Gogoi, who is the senior-most judge and is likely to be recommended to succeed Chief Justice Dipak Misra on his retirement on October 2.

A four-year-old girl today died after she fell into a nullah during heavy rains in Maharashtra’s Yavatmal district, a senior official said. District Collector Rajesh Deshmukh said that Akansha Anil Gaikwad was playing on the road near a nullah, in Chikli Kanoba village of Ner tehsil, when she fell into it. The incident happened at around 1:30 pm and the villagers, who found the girl in the nullah some distance ahead, rushed her to the local hospital where doctors declared her dead on arrival, he said.

The Supreme Court today rejected a demand for a referendum over the constitutional validity of section 377 of the IPC, saying it would not go by majority opinion but be governed by constitutional morality. “We do not decide constitutional issues by conducting a referendum. We follow the concept of constitutional morality and not majority morality. We don’t go by majority morality, rather we go by constitutional morality,” a five-judge bench headed by Chief Justice Dipak Misra told a lawyer favouring retention of section 377.
